By accessing or using the website at billericadeckandfence.com (the "Site"), or by entering into any service agreement with Billerica Deck & Fence, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this Site or our services. These terms apply to all visitors and customers.
Billerica Deck & Fence provides residential deck design and construction, fence installation, and related outdoor structure services in Billerica, MA and surrounding communities. All services are performed by licensed and insured contractors. Service availability is subject to scheduling, project scope, and geographic coverage at the time of inquiry. We reserve the right to decline any project at our discretion.
Estimates provided by Billerica Deck & Fence are based on the information available at the time of the site visit and are valid for 30 days from the date of issue unless otherwise noted. An estimate is not a final contract.
A written contract will be provided before any work begins. The contract will specify the scope of work, materials, total price, and payment schedule. The contract price is binding for the agreed scope. Changes to the project scope requested after the contract is signed may result in a written change order with an adjusted price. We will notify you before proceeding with any change that affects the cost.
Permit fees, when applicable, are itemized separately in the contract. Final pricing may be adjusted if site conditions discovered during construction differ materially from what was visible during the estimate, provided we notify you in writing before proceeding.
Project start dates are scheduled upon contract signing and receipt of the required deposit. Start dates are estimates and may be affected by permit approval timelines, material availability, or weather conditions. We will communicate any delays as soon as we are aware of them.
If you need to cancel a signed contract, please notify us in writing as soon as possible. Deposits are non-refundable if work has begun or if materials have been ordered specifically for your project. If cancellation occurs before materials are ordered and before work begins, we will discuss the deposit on a case-by-case basis.
We reserve the right to postpone or reschedule work due to unsafe weather conditions, including high winds, heavy rain, or frozen ground that would compromise the quality of the work.
Payment schedules are detailed in the written contract for each project. Typical arrangements include a deposit upon contract signing, a progress payment at a defined milestone, and a final payment upon project completion and your walkthrough approval.
Final payment is due upon project completion. Late payments may be subject to interest charges as specified in the project contract. Unpaid balances may result in suspension of any warranty or follow-up service until the balance is resolved.
We accept payment by check, bank transfer, or other methods specified in your contract. All amounts are in US dollars.
Where required by local law, Billerica Deck & Fence will apply for and obtain the necessary building permits before work begins. Permit fees are the responsibility of the customer and will be itemized in the contract. We will schedule all required inspections and coordinate with the relevant municipal authority on your behalf. The customer is responsible for ensuring the property is accessible for inspections.

Billerica Deck & Fence warrants that all work will be performed in a professional manner and in compliance with applicable building codes. Specific warranty terms, including duration and coverage, will be stated in your written contract.
Material warranties are provided by the manufacturers of the products used, not by Billerica Deck & Fence. We will assist you in understanding and filing a manufacturer warranty claim if needed.
Warranty coverage does not apply to damage caused by misuse, modification by others, failure to perform routine maintenance, acts of nature, or conditions that were present but not disclosed at the time of the estimate. Normal weathering and color changes in exterior materials are not covered under workmanship warranty.
To the maximum extent permitted by applicable law, Billerica Deck & Fence's total liability for any claim arising from our services or this Site will not exceed the amount you paid us for the specific project giving rise to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including loss of use of property, lost profits, or costs of substitute services, even if we were advised of the possibility of such damages.

These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
We may update these Terms and Conditions at any time. Changes take effect when posted to this page. The effective date at the top of this page will reflect the most recent revision. Continued use of this Site or engagement with our services after changes are posted constitutes acceptance of the updated terms.
